The former governor of Chihuahua (Mexico) César Duarte filed a new appeal against the United States government in the process that follows him for his extradition for the accusations of “conspiracy and embezzlement of public funds” that he faces in his country .
The extradition of Duarte, detained since July 2020 in Miami, was already ordered last November by Judge Lauren Fleischer Louis.
However, the Mexican’s defense presented this Wednesday the new amparo appeal before the Eleventh Circuit Court of Appeals, based in Atlanta (Georgia), according to the court file.
Last November’s ruling established that the extradition treaty is in force between both nations for what the procedure is to issue a “certification” to the US Department of State, which will be in charge of the repatriation for the “criminal offenses of conspiracy and embezzlement of government funds.”
“The Court has personal jurisdiction over the defendant and jurisdiction over the matter of the case”, the judge then specified.
The former governor of the border state of Chihuahua was arrested in the United States in July 2020, after escaping from justice since in October of 2019 a Mexican judge issued an arrest warrant against him.
Mexican authorities discovered “significant” irregularities in subsidy and loan programs for livestock producers and in an alleged purchase of real estate for the state.
According to demand, from June 2011 to November 2014 Chihuahua transferred more than 6.4 million dollars to two companies in which “Duarte was the majority shareholder”.
Duarte was one of the politicians with greater relevance in the once hegemonic Institutional Revolutionary Party (PRI) during the stage of renewal of the formation im pressed by the current former Mexican president Enrique Peña Nieto (2012-2018).
