The Brazilian authorities opened an administrative process to investigate whether the Chinese social network TikTok violates rights contained in the Consumer Protection Code, such as protection against harmful content, official sources reported this Monday.
The National Consumer Secretariat, a body linked to the Ministry of Justice, informed in the Official Gazette of the Union that it will initiate “preliminary investigations of irregularities and infringing conduct” by the popular platform.
According to the entity, there are “indications of infringement” of some articles of the Consumer Protection Code that deal with consumer protection against services “considered dangerous or harmful” and “misleading and abusive” advertising.
Brazil considers any “discriminatory advertising that incites violence, exploits fear or superstition” or takes advantage of the “weakness or ignorance of the consumer, taking into account their age, health, knowledge or social status.”
Last June, the National Consumer Secretariat already ordered to the social network to suspend the display of content considered “inappropriate” for minors.
TikTok, which will be able to present its defense once it is notified of the administrative process, then alleged that it already eliminates publications that are not in line with its content policy and guaranteed that it does not allow minors under 13 years of age to register.
The Chinese platform is the fastest growing social network worldwide and one of the most used by Brazilian users, in among which are the president of the country, the far-right Jair Bolsonaro, and former president Luiz Inácio Lula da Silva, who will face each other in the elections next October. 2022
