The Supreme Court will hear oral arguments on Tuesday in the lawsuit against the immigration arrest and deportation priorities of the Government of President Joe Biden, which focus on aliens who pose a risk to national security.
The Supreme Court judges will consider the lawsuit filed by Texas and Louisiana to stop the implementation of the Biden Administration’s priority guide, which asks Immigration and Customs Enforcement (ICE) agents to focus their efforts of detention in immigrants who pose a danger to the security of the United States.
The guide issued in September by the Secretary of Security Nacional, Alejandro Mayorkas, was blocked by the ruling of a Texas federal judge.
The sentence was ratified by the Fifth Circuit of Appeals, for which the administration of the Democratic president led the legal battle last July h to the highest court.
Aaron Reichlin-Melnick, an immigration expert at the American Immigration Council, described the lawsuit on his Twitter account as “a great case” that will be heard by the Supreme Court.
“Not only will it potentially have huge ramifications for immigration enforcement, but it could reshape the way states and private parties sue the government (over immigration),” he added.
The case centers on a ruling by Judge Drew Tipton of the Southern District of Texas, appointed by now former President Donald Trump, holding enforcement priorities on hold despite federal statute explicitly stating that the Secretary of Homeland Security “shall be responsible” for “establishing national immigration enforcement policies and priorities.”
The Department of Homeland Security (DHS) issued similar memos establishing enforcement priorities in 2010, 2011, 2017, 2011 and 2021, year in which Trump assumed the Presidency.
The priority guide issued by Mayorkas focuses ICE efforts on immigrants who pose a risk to the country’s security, including people convicted of serious crimes.
For his part, Texas Attorney General Ken Paxton has argued in his lawsuit that foreigners with a final deportation order are criminals who must be expelled from the country.
