A Florida macaroni and cheese consumer lost patience preparing her food and sued Kraft Heinz Foods Company for $5 million, alleging that the food takes longer than advertised to prepare.
The information was released by CNN, where it is indicated that it is a class action lawsuit for $5 million dollars against the food manufacturer, in which it is argued that Velveeta brand macaroni and cheese does not they comply with what they offer, since they take longer than advertised to prepare, according to court documents.
The lawsuit is led by Amanda Ramírez, of Hialeah, Florida, and was filed in United States District Court for the Southern District of Florida on November, according to their attorneys.
The judicial document says that the prosecution feels deceived because the brand ensures that the product is prepared quickly in 3 minutes and a half for individual portions of macaroni and cheese.
However, the advertising for Amanda Ramírez is false and misleading because when preparing the food in the microwave, the product takes longer than the promised time.
The consumer says in the court documents that the cup must be heated in the microwave for 3 and a half minutes, but the other steps that lengthen the preparation process, such as removing the lid and bag, are not considered of sauce, add water, microwave and stir.
A spokesperson for Kraft Heinz Foods Company told CNN that they will firmly defend themselves against the “frivolous lawsuit” and the allegations that emanate from it.
The plaintiff told her lawyers that the company sells the product at “a substantially high price” and that it promotes with a “misleading” marketing of “ready in 3 and a half minutes”, which creates expectations and instantly attracts the attention of consumers.
The woman It also requests that punitive damages be applied to Kraft Heinz Foods Company and that it be ordered to “cease its misleading advertising”.
