In 2020, a police officer identified as Breann Leath was killed when she responded to a domestic violence emergency call. Now, lawyers for the alleged culprit of said crime are arguing, in court, that she must have a legal defense for insanity, to avoid the death penalty.
The alleged perpetrator was identified as Elliahs Dorsey, who was arrested in April 2020.
According to information from Fox News, Dorsey’s lawyers filed a motion with the court indicating that in a report, state doctors indicated that Dorsey suffered from mental illness when he shot Officer Leath, who belonged to the Metropolitan Police Department of Indianapolis.
Leath died after being shot twice in the head while responding to a domestic violence call involving Dorsey. Together with her were 3 more officials.
For that event, Dorsey was arrested and charged with one count of murder and criminal confinement, as well as four counts of attempted murder. One of these charges was ruled for allegedly shooting a woman he had at his residence.
Dorsey’s lawyers acknowledged that they filed the insanity defense motion a little later than normal, but justified the delay due to the procedural and administrative problems caused by COVID-19.
Dorsey’s trial will begin on September 18, and prosecutors have already announced that they will try to convict him and obtain a death sentence.
The death of Officer Leath caused a great shock in public opinion. Leath was a National Guard veteran, survived by a 3-year-old boy, as well as her parents, who worked for the Marion County Sheriff’s Office, and her sisters.
As a tribute to her death in service, the Indiana Women’s Prison Infirmary was renamed the “Officer Breann Leath” Maternal and Child Health Unit by the Governor of Indiana two weeks after her death.
