However, according to experts consulted by The Hill, doing this would not be so simple, since a president does not have the right to eliminate this amendment by executive decree.
The reason for this is that this amendment is in the US Constitution.
In fact, this amendment (which guarantees the right to citizenship for children born in the United States regardless of the immigration status of their parents) has been in place since 1868.
United States law guarantees the right to citizenship to all persons born in the country, including former slaves, and provides all citizens the same protection under the laws of the country.
This is the interpretation that governs when evaluating the fourteenth amendment, since, according to The Hill, it was the interpretation given in a case involving a US citizen. with parents from China in 1898.
According to Trump’s campaign command, the executive decree that the former president will issue, if he is re-elected, will indicate that children born to foreign parents will not have the right to obtain nationality, as dictated by the Constitution.
According to research by the Pew Research Center, at least four out of five Latinos are US citizens, including those who were born in the US, as well as immigrants who have become naturalized citizens.
The percentage of Latinos in the US who are now US citizens has increased from 74% in 2010 to 81% in 2021, according to the Pew Research Center.
