A 65-year-old man fatally shot another who allegedly tried to rob him near his home this morning in Queens (NYC).

Authorities said the shooting occurred on 82nd Avenue in Kew Gardens around 2 a.m. Wednesday.

The 32-year-old alleged intruder was armed with an apparent sharp object and tried to steal money and cigarettes from an unidentified man, who pulled out a gun and shot him up to five times. He then called 911, reporting the shooting and said the gun was in his jacket pocket. He voluntarily turned himself in to the responding officers.

The suspect was pronounced dead at the scene and a pen was discovered in his right hand. He had no more weapons in his possession. His name was not released, but he had many prior arrests for robbery, theft, drug possession and other related charges, he reported. ABC News.

Police said the gunman had a weapons permit, but it was not clear if it was for the revolver used, they said. Daily News.

Queens District Attorney Melinda Katz toured the scene while considering what charges to file. “We are still investigating and as soon as we have all the facts, we will make those decisions,” Katz told reporters. “This is a complicated case and we are going to review the evidence.”

In a similar case, last week a 28-year-old Latino was arrested on suspicion of involuntary manslaughter for fatally stabbing another Hispanic whom he allegedly caught stealing the wheels of his luxury car on Long Island (NY).

All charges are mere accusations and those charged are presumed innocent until proven guilty in court.
