One of the most important legal challenges facing former President Donald Trump at the moment has to do with the 14th Amendment to the United States Constitution, specifically section 3 of said Amendment, since it could prevent Trump from running for president in the year 2024.

According to the Político portal, the 14th Amendment to the Constitution was established to prevent officials who were accused of being involved in “insurrections or rebellions” against the United States or having given aid or “comfort” to their enemies.

The federal accusations against Trump, indicating that he led an alleged “insurrection” against the United States on January 6, 2021, are precisely some of the factors that could disqualify the former Republican president from the presidential race, according to the amendment.

In fact, according to legal discussions reviewed by Politico, there is even a possibility that Trump’s actions could disqualify him without the need for him to be found guilty of the charges.

Noah Bookbinder, executive director of the Washington Citizens for Responsibility and Ethics group (Crew), told The Guardian that disqualification under the 14th Amendment could come without a guilty plea, and that his group is already preparing to litigate in several US states to disqualify Trump from the electoral contest.

Currently, the requirements in the United States to be president are met by former President Trump.

Some of the requirements include being at least 35 years old, being a US citizen born in the country and being a US resident for at least 14 years.

Likewise, the Constitution prevents that any person who has served two presidential terms can aspire, again, to reach the White House.
