Ten asylum seekers who sued the Joe Biden government for not considering their requests filed at ports of entry on the southern border of the United States without having a prior appointment managed to enter the country, their lawyers reported.
On July 27, the organization Al Otro Lado, the Haitian Bridge Alliance, and a group of 10 asylum seekers located in the border city of Tijuana, Mexico, filed a class action lawsuit against the Biden Administration for rejecting people who request asylum in the US southern border ports of entry without an appointment.
In a message on the social network X (formerly Twitter), Al Otro Lado said that the 10 applicants were able to enter the country.
The Biden Administration imposed a rule last May that requires asylum seekers to obtain an appointment on the CBP One app in order to present their cases at the country’s ports of entry.
The move has been criticized for the barriers faced by many applicants who are unable to access the application. Nicole Ramos, director of Al Otro Lado, described the measure as “illegal.”
“The irony is that the government rejects people, leaving them stranded in camps and shelters in Mexican border cities that are so violent that the United States Department of State itself limits the travel of its employees to these regions,” the activist told EFE. when filing the claim.
The legal complaint maintains that the Government’s policy of returning asylum seekers who do not have an appointment by CBP One violates United States law, the Government’s own guidance, the rights of applicants to due process and the obligations of States. United under international law, which prohibits the government from returning refugees to countries where they face persecution or torture.
Although the applicants managed to enter the United States, the lawsuit against the measure requiring the appointments is ongoing in a federal court in San Diego, California.
