Former President Donald Trump does not have immunity and can be sued through civil proceedings for the attack on the Capitol, which occurred on January 6, 2021, after he called for the results of the presidential elections to be ignored, in which Joe Biden was the winner. This was determined this Friday by the Court of Appeals for the District of Columbia.
The Washington court, Efe noted, affirmed that the Republican, as a presidential candidate, acted in a personal capacity when he urged his followers to protest in front of the Capitol, in an attempt to prevent the certification of the Democrat’s victory.
Presidential immunity protects leaders in the United States from civil lawsuits only for official actions, the news agency indicated. Thus, The Washington Post newspaper indicated that the judges can appeal the decision issued this Friday.
The US Department of Justice considered on March 2 that Donald Trump could be sued because he did not have immunity. The former president has received multiple civil lawsuits from police officers and members of the United States Congress, who accuse him of having responsibility for the events.
A law requires government officials to use force, threats or intimidation and allows anyone harmed by those actions to receive compensation. The agents relied on this rule.
On the other hand, Efe recalled, Donald Trump, like his lawyers, considers that he was protected by presidential immunity and that his speech prior to the assault on the Capitol, which motivated his followers to head towards the building in a violent manner, was part of his work.
