The Court of Appeals for the Fifth Circuit extended the suspension of the SB4 law in Texas, with which the state government seeks the detention of immigrants and their deportation process.
Although it is not a final decision, this represents a defeat for the government of Republican Greg Abbott, who defends the application of the rule to authorize state police to carry out immigration actions.
The two-judge-one decision is temporary while the court determines whether SB4 allows actions that fall to the federal government.
The Fifth Circuit reviews the application of the law, after the Supreme Court returned the case, in a legal battle where President Joe Biden’s government asks for the cancellation of the rule promoted by Republicans.
Governor Abbott has defended the law and said that even without the court’s endorsement he would move forward with immigration detention. This as part of his Operation Lone Star.
