A 19-year-old young man who was in the Juvenile Detention Center in Albuquerque was recaptured this Sunday, May 26, after his attempt to escape, after pleading guilty last month to the charges for which he is accused.

Josef Toney pleaded guilty in April to two counts of first-degree murder after shooting to death two people and wounding one more at an apartment complex in January 2021, when he was 16 years old.

He opened a door and escaped from prison

Bernalillo County Sheriff John Allen held a conference to give details about Toney’s escape and capture. Josef escaped from the Juvenile Detention Center in Albuquerque on Saturday, May 25.

Through surveillance cameras they could see Toney opening a door and fleeing the jail around 1:20 in the afternoon.

A person who lives near the Detention Center was able to see when the young man escaped from the place running east from Second NW, just north of Griegos, and immediately alerted authorities.

Jayme Fuller, spokesperson for the Bernalillo County Sheriff’s Office, asked residents of the area to “remain alert and report any sightings or information related to the whereabouts of Josef Toney,” after learning of the escape that went to 6:00 in the afternoon.

He was recaptured and taken into custody.

Sheriff Allen and County Deputy Director of Public Safety Greg Perez said, through the conference, that Toney was recaptured on Sunday morning, May 26.

“Josef Toney has been taken into custody by BCSO deputies and booked into the Metropolitan Detention Center (MDC),” the Sheriff wrote announcing his capture.

County prosecutors said Toney would be sentenced June 26, and faces possibly up to 51 years in prison.

He fatally shot two people and left one injured

Josef Toney was 16 when he shot and killed Ariel Mallum, 21, and Jessica Lucero, 31, at the Aztec Village Apartments in Montgomery, near Jefferson. The shooting occurred in late January 2021.

The prosecutor said the fatal shooting happened in front of Mallum’s four-year-old daughter. As Toney fled, he also shot and wounded a man three times who survived the shooting.

Josef also faces charges of armed robbery, two counts of aggravated assault, child abuse and tampering with evidence. Now, with the attempt to escape from prison, he has an additional charge of escape or attempted escape from prison.
