Miami-Dade Circuit Judge Richard Hersch postponed the hearing that was scheduled for this Wednesday in the case against Derek Rosa, accused of stabbing his mother to death last October.
Hersch ordered that the status of discovery be put in writing. Between today and tomorrow, the dates of the subsequent meetings between the parties must be determined, and the Arthur hearing in which it will be decided whether the minor under 13 years of age will be granted bail, according to the NBC 6 report.
During the discovery process, prosecutors and attorneys exchange information to prepare for trial.
Since he was arrested for the events reported on the night of October 12, Rosa has remained detained in an adult prison in Doral.
In the middle of last month, Rosa’s defense again asked the judge that their client be transferred to a juvenile detention center.
“We are extremely worried. We continue to monitor the detention. “We do not believe that it is constitutional for him to spend more than 80% of his day in a cell, and we do not believe that it is constitutional for a child to take classes for less than nine hours in a month for months and months at a time,” he stated in that moment one of the minor’s lawyers, Dayliset Rielo, told the press.
At that same hearing, prosecutors insisted they were ready for trial. The lawyers argued, for their part, that they did not have all the evidence that they requested from the Public Ministry.
To try to resolve the controversy, the judge told the defense that they could present their case for more time.
Rosa has confessed to the facts on at least two occasions. One of these was during a 911 call shortly after the attack at her family apartment in Hialeah.
According to authorities, Rosa used a kitchen knife to stab her mother Irina García, 39, at least 40 times.
The crime was reported in the victim’s room while she was sleeping. Rosa’s newborn sister was sleeping in a nearby crib. The minor was not injured.
After the events, Rosa sent three images to a virtual friend with whom she played video games. Two were of García’s lifeless body, and the third, a selfie in which she is seen making a sign with her bloody hand while he sticks out his tongue.
The motive for the crime is unknown.
Rosa, who is being tried as an adult, faces charges of first-degree murder.
Hours before the murder, a surveillance camera at the entrance to the house shows a brief exchange between Rosa and her mother.
In the images, the woman can be seen breastfeeding her baby sitting in a chair in the living room.
Rosa asks him in Spanish: “Why do you always tell me not to run?” The young man then disappears from the scene.
