The Supreme Court ruled Friday that Americans do not have a constitutional right to challenge the State Department’s denial of spousal visa applications.
In this way, the judges reject Sandra Muñoz’s attempt to complain to the federal government for rejecting the visa of her husband Luis Asencio-Cordero, originally from El Salvador, accusing that he was discriminated against because of his tattoos.
The 6-3 opinion was written by Judge Amy Coney Barrett and states that American spouses do not have a “sole” interest in having their spouse admitted to the United States.
In this way, the Supreme Court supports the denial of visas for the spouses of US citizens, even if it means that the couple cannot live together in the country.
