A Delta passenger has filed a lawsuit in New York against an airline employee for allegedly hitting her multiple times with the beverage cart.
The events that led Gail Hamilton to file the legal action occurred on June 21, 2022, according to the New York Post report.
That day, the woman was traveling on a Delta Air Lines flight that took off from Paris, France, to John F. Kennedy International Airport (JFK) in New York on flight 263.
Hamilton was in an aisle seat on the plane when a flight attendant allegedly unexpectedly hit her multiple times with the loaded cart. The passenger is said to have suffered serious injuries to her right shoulder.
It is unclear whether there was any verbal altercation between the parties prior to the alleged attack.
Hamilton, who is seeking unspecified damages, alleges Delta was negligent in failing to both train employees and safely operate food and beverage carts.
The lawsuit was filed on August 7 in the District Court for the Southern District of New York.
Hamilton and his lawyer have declined to comment to the press on the case, nor has the airline.
Also this week, it emerged that Delta customers have filed a class-action lawsuit over delays and cancellations experienced last month due to software firm Crowdstrike’s global computer outage on the Windows operating system.
The appeal arose as a result of the airline’s refusal to reimburse passengers for lost time.
Most airlines were able to restore service within a couple of days. However, in Delta’s case, some customers continued to experience service interruptions until July 31, about two weeks after the outage.
The company cancelled more than 4,500 flights between July 19 and July 21. Additionally, they cancelled another 1,250 on July 22.
